Jessica Denson & Protect Democracy Will Continue the Fight Against Illegal Trump NDAs

Today’s acknowledgment by the Trump campaign (now, the Make America Great Again PAC) that it will not attempt to enforce its overly broad 2016 non-disclosure agreement (NDA) is a victory for free speech and the truth. It follows a March 30, 2021 court victory for Jessica Denson in her class action challenging the NDA, holding that the NDA is invalid and unenforceable. The Trump campaign’s NDA, however, poses a continuing danger to constitutionally protected rights of free speech and threatens to cut off public access to critical information about candidates for public office and public officials. While today’s letter is a step in the right direction, it is not legally binding and therefore doesn’t resolve the class action. Protect Democracy along with Bowles & Johnson PLLC, and Ballard Spahr LLP are continuing to press forward on behalf of Lead Plaintiff Jessica Denson and everyone who signed this NDA to ensure that no one can attempt to enforce this illegal contract.
“In another resounding victory for my team, the Trump campaign is waiving the white flag in my years long battle for truth and accountability,” said Denson, “But we will not allow the Trump campaign to circumvent the legal steps necessary to ensure that these NDAs are wholly unenforceable by both the Campaign itself and the multitude of third parties it purports to empower, including the former president himself.”
